A Bench comprising Justices L. Nageswara Rao, B. R. Gavai, and A. S. Bopanna clarified that the directions so passed would hold the field till the time the Union Government comes up with legislation. The Bench said - 'It need not be gainsaid that notwithstanding the profession, every individual in this country has a right to a dignified life under Article 21 of the Constitution of India. The Constitutional protection given to all individuals in this country shall be kept in mind by authorities who have a duty under the Immoral Trafficking Prevention Act. 'Additional InformationSection 304B of The Indian Penal Code deals with 'Dowry death'. 'Where the death of a woman is caused by any burns or bodily injury or occurs otherwise than under normal circumstances within seven years of her marriage and it is shown that soon before her death she was subjected to cruelty or har­assment by her husband or any relative of her husband for, or in connection with, any demand for dowry, such death shall be called 'dowry death', and such husband or relative shall be deemed to have caused her death. 'Section 354D of the IPC gives the definition of Stalking as an offence. 'Any man who follows a woman, contacts her or attempts to contact her for personal interaction time and again even after the woman has indicated clearly that she is not interested in making an acquaintance, amounts to stalking as per Section 354D. This Section also covers online stalking that is to say monitoring her use of the internet, email or other forms of electronic communications. ' The article also enlightens the Section as a legal provision for the protection of women. Section 306 of the IPC deals with the Abetment of suicide 'If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. '
